Introduction

Tego Inc.,or its affiliates meaning the specific company that has provided or referred you to this Privacy Statement (collectively, “Tego”, “our”, “us”, or “we”) are committed to protecting your personal information. This Privacy Statement explains how we, as the “data controller”, collect, share, disclose, use and transfer (hereinafter “process”) your personal information and how you can exercise your data privacy rights. The personal information that we collect about you depends on the context of your interactions with us, the websites, the products, services and applications that are linked to this Privacy Statement (collectively, our “ Services”). This Privacy Statement does not apply when we process personal information on behalf of our customers as a “data processor.” For more information relating to a Tego customer who uses our Services, please refer to “Information we process on behalf of our customers“.

When we interact with you, we may also provide you with additional privacy notices about specific processing activities or offer you additional choices about how Tego processes your personal information at that point in time.

Our collection of information

We may collect the following personal information from you when you interact with us:

  • Identity data, such as your name, title, company/organization name, e-mail address, telephone numbers and physical address (including street, city, state, postal or zip code, and/or country or region) and government identifiers.           
  • Business contact data, such as information related to other employees, owners, directors, officers, or contractors of a third-party organization (e.g., business, company, partnership, sole proprietorship, non-profit, or government agency). This information may be provided directly by you or indirectly by a third party (for e.g., if you are employed by a customer or supplier of ours of where your information has been shared with us for a legitimate business purpose).
  • Registration data, provided by you (including username and password) when you register an account on our websites, portal or a mobile application to use our Services, or to receive communications, download content, sign up for an event, webinar, training, certification or survey.
  • Marketing, communications data and social listening, including your marketing preferences, your subscriptions to our publications and analyze and monitor conversation streams and monitor publicly available opinions, statements or other interactions on social media channels (e.g., LinkedIn) to understand sentiment, intent, mood and market trends and our customers’ needs and thereby improving our Services.
  • Transaction data, including inquiries about orders for our Services and billing information, including purchase order history. If you do not provide the requested information, we may not be able to provide you the requested Services or complete your transaction.
  • Communications content and recordings, such as emails, calls, recordings and transcriptions, texts, chats, voice and logs from your communications with us including communication channels supported by AI.  When you email, call, or otherwise communicate or interact with us or with other Tego users, including if you sign up for our mailing lists, complete forms on our websites, interact with our social media pages, post a product review or testimonial, submit content in any online discussion groups, participate in a web-conference, or otherwise enter information into public-facing comment fields, blogs, or community forums sponsored by or affiliated with Tego, we may collect and maintain records of your contact details, communications and interactions, your posts or submissions, and our responses, if applicable. We, and our third-party service providers and partners, may also collect and record any information you submit through our websites and online services, such as through our web-conference platforms, chat functions, or virtual assistants, and we may also maintain communication records regarding information provided to us related to any customer support requests.
  • Usage data, including license consumption data, information about how you use our Services, what pages you view, the number of bytes transferred, the links you click, the materials you access, the date and time you access the Services, the website from which you linked to one of our Services and other actions taken within the Services. For more information about the cookies and other similar tracking technologies we use on our Services, please refer to our Cookie Notice.
  • Device data, such as your IP address, device identifier, service provider, browser and device type, capabilities and language, operating system and other technical information about your device.
  • Your feedback, including surveys, recommendations, or other feedback from you about our Services.
  • Financial information, including credit card, bank account information or other financial information for the purpose of enabling us to facilitate your purchase of Tego Services.
  • Export control and sanctions information, such as your nationality, citizenship and country or region of residence, that allows us to determine your eligibility under export control and sanction regulations to receive information about certain technologies.
  • Geo-location information. For certain Services, with your consent, we may collect the precise, real-time location (i.e., geo-location) of your mobile device. This information will be used only for purposes of facilitating your use of the Services including by our service providers who may process this information in connection with providing services on our behalf. If given, you may adjust this consent by managing your location services preferences through the settings of your mobile device.
  • Emergency contact information such as name, telephone number, email address, and relationship provided either directly by you or indirectly by another individual (e.g., your spouse, guardian or employer) to contact in an emergency.
  • Information collected from third parties, such as social media websites (e.g., LinkedIn, Meta, Twitter), business intelligence applications (e.g., ZoomInfo) and third party risk management services which we may combine with information we already hold, to help us improve and customize our Services to your preferences and for other purposes set forth in this Privacy Statement. We may also collect your business contact information from your employer or other third parties to facilitate or otherwise engage in traditional business activities and similar administrative matters.
  • Information we process on behalf of our customers. While using our Services, our customers may collect personal information about you and provide it to Tego for processing on their behalf. This personal information is processed by us on behalf of the customer and in accordance with the terms of our contract with the customer. We are not responsible for the privacy or data security practices of our customers, which may differ from those explained in this Privacy Statement.  
  • Recruitment data, including information submitted in connection with a job application or inquiry.
  • Video surveillance including photos, images captured or recorded on CCTV or other audio, video (where legally permitted) and related security/monitoring systems or captured when you visit our sites or during marketing/public filming events/sessions (including recording of virtual or live workshops or similar events/sessions).
  • Diversity data. Some of the personal information we collect about you may be “sensitive personal information” or “special categories of personal information” such as health, race, and ethnicity. We use such information only when necessary to achieve the relevant processing purposes (e.g., related to diversity and equality of opportunity) or for compliance with a legal obligation.

Our use of information

We may use your personal information for the following purposes:

  • Business contact data: to engage in communications or transactions, including conducting due diligence regarding, or providing or receiving, Services. For e.g., Tego may collect and use this business contact data to facilitate and manage orders, contracts, warranties, maintenance, and similar business functions, for credit analysis and collection purposes, to assist with our own internal compliance and legal requirements, and (if necessary) to defend our interests and claims.
  • Procurement and contract management data:  provided by you or another third party that is necessary for the creation, execution, management and performance of a contract (e.g., tenders, leases, contracts or purchase orders). We may also store contracts containing your personal information in applications such as Salesforce.
  • Account management, services and transactions: to deliver services to you or carry out transactions you have requested, including personalized interactions, providing information on Tego Services you have purchased or otherwise use, registering purchased products, processing product orders, handling warranty claims, replacing product manuals, answering customer service requests and facilitating the use of our Services.
  • Administering and protecting our business and Services: to administer and protect our business and our Services, including tracking use of our websites, verifying and investigating activity, fraud, cybercrime, troubleshooting, system maintenance, support, reporting and hosting of data.
  • Improving our business and Services: to perform business analyses or for other purposes that help us to develop and improve the quality of our business, Services, products and services (including new products and services), for e.g., by customizing our Services to your particular preferences or interests.
  • Compliance: to ensure compliance with legal obligations (such as record keeping obligations), export control and customs, customer, supplier and other third-party compliance screening obligations (to prevent white-collar or money laundering crimes), sanctions, and our policies or industry standards.
  • Marketing: to inform you of products or services which may be of interest to you, and to otherwise communicate with you about offerings, events and news, surveys, special offers, and related topics. You can opt-out from marketing communications sent via e-mail at any time, free of charge by using the “unsubscribe” link in any e-mail marketing materials you receive from us, or by contacting us using the contact information listed in this Privacy Statement. Depending on your country or region of residence, you may also be able to opt out of other types of marketing communications. Please contact us using the contact information listed in this Privacy Statement for more information. Some jurisdictions provide individuals (e.g., California residents) with the right to request certain information regarding our disclosure of personal information to third parties for the third party’s direct marketing purposes.  For more information on our data disclosure practices for marketing purposes, please contact us in accordance with the instructions listed below.
  • Interest-Based Advertising: to provide advertising that is most relevant to you based on data we collect about your online activities to identify your interests. You can opt out of receiving interest-based advertising from Tego as described in our Cookie Notice.
  • Employment applications for the purpose of employment consideration, background checks and employment eligibility when you inquire or apply for a job with us or members of our group and provide information about yourself such as resume/CV, professional references. We may use a third party (e.g., job recruiter) or social media platform to solicit, collect, and retain employment applications. For more information, please read our Applicant Privacy Notice.
  • Research and analysis: to conduct research and analysis to help us analyze your purchasing preferences, identify the products and services that best meet your requirements and measure the effectiveness of the advertising we provide you with.
  • Conference Platforms: Tego uses web-based conferencing platforms and applications (each a “Conference Platform”) for the purpose of hosting or conducting video and audio meetings and conferences, webinars and similar training exercises, social events, and other types of video and audio meetings (collectively, “Conferences”). The type of personal data processed by Tego via a Conference Platform depends on the scope and nature of the Conference, and may include your identity data, registration data, transaction data, device data, and other information furnished to Tego during the Conferences. Please note that Tego, and our third-party service providers and partners, may record our Conferences, including the content of communications and activities that occur therein, and Tego may use and disclose such content, information and data for our own business purposes. By participating in a Conference, you hereby consent to such recording, use, and disclosures. You may withdrawal your consent at any time by (i) providing written (email acceptable) or verbal notice to Tego prior to the start of the Conference, or (ii) providing a verbal notice to the Tego meeting host during the Conference. You may not furnish a Tego-provided access code or a link to a Conference without this, and all other appropriate, disclaimers. Please see the privacy statement for the third-party platform service provider (e.g. Microsoft Teams or Zoom) for a description of its Conference Platform privacy practices. You may request access to a Conference recording or transcript at any time. Tego prohibits third-party recording devices or processes, including chat/recording bots, on a Conferencing Platform, without express written permission from Tego’s IT DepartmentPlease ensure data and privacy protection in the background of your Conference (e.g., by notifying bystanders of the Conference, using the background masking function), where technically feasible.

Where permitted by law, we may combine the information that we collect via our Services with other information we hold about you (such as information about your use of our products and services) to offer you an improved and consistent customer experience when interacting with us or for other purposes set forth in this Privacy Statement.

The legal basis on which we process information

Where required by law, we will ensure there is a legal basis for the processing of your personal information. In most cases our legal basis will depend on the personal information concerned and the specific context in which we collect it. The processing of your personal information will take place based on one (or more) of the following legal bases where and to the extent they exist or are permitted by applicable law:

  • Conclusion or performance of a contract: the processing is necessary for the performance of the Services we provide to you, or to take steps (at your request) prior to, and anticipation of, performing, such Services;
  • Legal obligation: the processing is necessary to comply with our legal obligations, including compliance with applicable laws, regulations, governmental and quasi-governmental requests, court orders or subpoenas;
  • Consent: the processing is based on your consent to the processing of your personal information for one or more specified purposes (e.g., marketing);
  • Legitimate interests: the processing is necessary to meet our legitimate interests, for e.g., to develop and improve our Services for the benefit of our customers, so long as those legitimate interests are not overridden by your fundamental rights or interests.
  • Vital interests: the processing is necessary to respond to a public health emergency, or to protect your life, health or property in an emergency (for e.g., health and safety reasons if you attend a meeting at a Tego location).
  • Public information: personal information (including “special categories of data”) that has been made public lawfully.

Anonymizing information

In accordance with applicable law, we may anonymize your personal information so that it can no longer be used to identify you. Anonymized information is not considered personal information and is therefore not subject to this Privacy Statement. We may collect, use, aggregate and share anonymized information for any purpose.

How long we keep information

The period during which we store your personal information varies depending on the purpose for the processing. For e.g., we store personal information needed to provide you with products and services, or to facilitate transactions you have requested, for so long as you are a customer of Tego or if you submit an employment application via our Services, we will retain details of your application as set forth in the privacy notice made available to you in connection with your application or as otherwise required by law. In all other cases, we store your personal information for as long as it is needed to fulfil the purposes outlined in this Privacy Statement, following which time it is either anonymized (where permitted by applicable law), deleted or destroyed.

Disclosure of information

We may share your personal information with selected third parties in accordance with applicable law, including as set out below. Depending on the law of your residence, we may provide you with further information on the entity names, scope of processing performed on our behalf or other related information by contacting us as indicated at the bottom of this Privacy Statement.

  • Our group companies. We may share your personal information with our affiliates and group companies as reasonably necessary for the purposes set out in this Privacy Statement.
  • Service providers. We may share your personal information with companies with which we have contracted to provide services on our behalf, such as hosting websites, conducting surveys, processing transactions, analyzing our Services and performing analyses to improve the quality of our business, Services, products and services. We require these service providers to protect the confidentiality of your personal information.
  • Distributors and other trusted business partners. We may share your personal information with third parties that distribute our products and other trusted business partners for purposes that include allowing those third parties to send marketing communications to you. Such sharing of personal information for marketing purposes will be performed in accordance with applicable law.
  • Disclosure in connection with transactions. In connection with certain transactions, we may disclose some or all of your personal information to financial institutions, government entities and shipping companies or postal services involved in fulfilment of the transaction.
  • Disclosures in connection with acquisitions or divestitures. Circumstances may arise where for strategic or other business reasons Tego decides to sell, buy, divest, merge or otherwise reorganize businesses in some countries. We may disclose information we maintain about you to the extent reasonably necessary to proceed with the negotiation or completion of a merger, acquisition, divestiture or sale of all or a portion of Tego’s assets.
  • Disclosure for other reasons. We may disclose personal information if required or authorized to do so by law or in the good-faith belief that such action is necessary to comply with legal requirements or with legal process served on us, to protect and defend our rights or property or, in urgent circumstances, to protect the personal safety of any individual.

International transfers

If you are accessing our Services from outside the United States, please be aware that your personal information may be transferred to, held, stored or used across various locations worldwide such as the US, UK and India in accordance with applicable law. This means that when we collect your personal information it may be processed in countries or regions that may have data protection laws that are different to the laws of your country or region of residence. However, Tego will always take reasonable steps to protect your privacy and provide a level of protection of personal information that is comparable to that of your country or region of residence which may include implementing the Standard Contractual Clauses of the European Commission or any other jurisdiction as applicable.

Your data privacy rights

Depending on applicable law, you may have certain rights with respect to your personal information.

  • You may have the right to access, correct, update or request deletion of your personal information.
  • You can object to the processing of your personal information, ask us to restrict processing of your personal information or request portability of your personal information.
  • You may have the right not to have a decision made about you that is based solely on automated processing, including profiling if that decision produces legal effects about you or significantly affects you.
  • Similarly, if we have collected and process your personal information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.
  • You may have the right to opt out of the sale of your personal information. Tego does not sell your personal information to third parties for profit. However, we do share or otherwise disclose your personal information to third parties in accordance with this Privacy Statement and our Cookie Notice.  For e.g., we engage with third parties to distribute our products, provide you with technical assistance, operate website analytical tools and features, and engage in marketing and sales of our products and services. Such activities may involve the disclosure of your personal information to third parties and may be considered a “sale” of data under certain (but not all) data protection laws.
  • You have the right to complain to a data protection authority responsible for overseeing compliance with data protection law in your jurisdiction about our collection and use of your personal information if you believe our processing of your personal information does not comply with applicable data protection law. For e.g., individuals in the EEA have the right to lodge a complaint with the competent Data Protection Authority, a list of which can be accessed at: https://edpb.europa.eu/about-edpb/board/members_en.  Individuals in Texas have the right to lodge a complaint with the Texas State Attorney General . We would however appreciate the opportunity to address your concerns, so please feel free to contact us regarding any complaint you may have.  We will not discriminate against individuals for exercising their data privacy rights.

We will facilitate your exercise of the rights that apply to you in accordance with applicable law. However, even if your personal information is not afforded protection under, or otherwise subject to, a data protection law, we may seek to accommodate any request or inquiry you may have regarding our data processing activities. Children’s information

Our Services are not directed to, and should not be used by, children or minors as defined under applicable law and we do not knowingly collect, use or sell information from such individuals. If you are a child or a minor as understood by the laws of your country or region, please do not submit any personal information through our Services.

Links to other websites

Our Services may contain links to third-party websites, products and services. We have no liability or responsibility for those websites, products and services, their policies, or their collection or other processing of your personal information. The practices of those third parties are governed by their own privacy policies. We encourage you to learn about the privacy policies of those third parties.

Video links

We may include videos and similar media players on our, and authorized third party, websites. By clicking on such videos and similar media players, (i) you may be redirected to a third party’s website to play the video, or (2) it may play the video on our websites, although this functionality may be supported by a third party’s website or technology (e.g., YouTube, YouTube API, Vimeo). In any such case, by playing the videos or similar media players, you will become subject to the third party’s terms and conditions, including, but not limited to, its terms of service and personal information privacy policies and practices, including the terms governing YouTube and Vimeo . By accessing our Services, your personal information may be disclosed to our third-party service providers who furnish us media and video capabilities on our Services, including through the use of third-party cookies and pixels owned and/or operated by these third-party service providers.
